These Terms of Service ("Terms") govern your use of the NEVYR LTD ("Company") website nevyr.io ("Website") and its software products and digital curriculum ("Services"). By accessing or using the Website and its Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Website or its Services.

User Eligibility and Account Registration

To use the Services, you must be at least 16 years old. To access certain features and Services, you must register for an account by providing your name, email address, password, business name and business role. You are responsible for maintaining the confidentiality of your account information and are fully responsible for all activities that occur under your account.

User Content and Conduct

Users may be able to post or share text and images on the Website, where applicable. You agree not to post or share any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable, as determined by the Company in its sole discretion. You are responsible for any content you post or share, and you grant the Company a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to use, store, display, reproduce, modify, create derivative works, perform, and distribute your content.

The Website, its content, software, and the Company's trademarks are the property of the Company and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Website and its content, including the software and any digital curriculum, for your personal, non-commercial use, except where software has been deployed under your own account to share with downstream users.

As part of the Services, the Company may provide templates and other resources designed to help learners build their own software. You are permitted to use these templates and resources for the purpose of creating your own software or projects, as long as you do not claim ownership of the original templates or resources provided by the Company. Any modifications or derivative works created using the templates or resources must be sufficiently distinct from the original materials provided by the Company and must not infringe on the Company's intellectual property rights.

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Website, its content, software, or any digital curriculum, without express written permission from the Company. Any unauthorised use of the Company's intellectual property may result in the termination of your access to the Website and its Services.

Payment and Billing

We accept payments through Stripe or bank transfer. Prices, billing cycle and subscription plans for our Services are set by individual products. VAT will be charged where applicable.

Refund Policy

To make a refund request, email support@nevyr.io, explaining your reasons for requesting a refund. Refunds issued may not cover days where software has already been accessed. Refunds, once approved, will be processed within 14 days.

Termination of Accounts

We reserve the right to terminate your account for any reason, including but not limited to, violation of these Terms, illegal activity, or non-payment of fees. Upon termination, your right to use the Website and Services will immediately cease. The Company shall not be liable for any losses or damages resulting from the termination of your account.

Disclaimer and Limitation of Liability

The Website and its content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. The Company disclaims all warranties, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. The Company does not warrant that the Website will be error-free, secure, or uninterrupted, or that defects will be corrected.

In no event shall the Company be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Website; (ii) any conduct or content of any third party on the Website; (iii) any content obtained from the Website; and (iv) unauthorised access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed its essential purpose.

Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of England, United Kingdom. Any disputes arising from or in connection with these Terms shall be resolved by litigation in the courts of England, United Kingdom.

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on the Website. Your continued use of the Website and Services after any changes to the Terms constitutes your acceptance of the new Terms.
